We supported women’s fitness owner Doris Lange – now we are under attack.

At the begin­ning of June, thanks to over 4,000 sup­port­ers (thank you!), we raised a large sum to help Doris Lange, an entre­pre­neur from Erlan­gen, to pre­serve her domes­tic rights and her fit­ness stu­dio as a shel­ter for women(here is all the infor­ma­tion about the fundrais­ing cam­paign for Doris Lange). Now we have become a tar­get our­selves. The man who want­ed to become a mem­ber of the only women’s fit­ness stu­dio in Erlan­gen wants us to stop refer­ring to him as a man. We can’t fol­low that. If he were a woman, no woman would have prob­lems train­ing or show­er­ing in the same room as “her”. But change of sta­tus or not, he is a man, which every woman sees or feels when she lies next to him on the sports mat or stands in the show­er — she naked, he in his swim­ming trunks, as he orig­i­nal­ly sug­gest­ed. This is impor­tant for every­one and essen­tial for an asso­ci­a­tion that is com­mit­ted to pro­tect­ing women and chil­dren.

What effort and costs will we incur?

The effort and costs depend on the instances.

  1. Instance and warn­ing: Reject warn­ing and cease-and-desist order, pos­si­ble costs: approx. 18,000 €.
  2. Appeal: We can appeal against an incrim­i­nat­ing judg­ment of the 1st instance. Costs unknown.
  3. Con­sti­tu­tion­al com­plaint: If no fur­ther instance is pos­si­ble, con­sti­tu­tion­al com­plaint to the Fed­er­al Con­sti­tu­tion­al Court. Costs also unknown.

How did the warning come about?

As the Frauen­heldin­nen e.V. asso­ci­a­tion, we raised a large sum of mon­ey for Doris Lange with­in a short space of time as part of a suc­cess­ful sup­port cam­paign.

In all these texts, we remain ground­ed in real­i­ty and call gen­der by its name. We avoid using terms such as “trans woman” and “she” or “trans woman” or even “woman” even if the man in ques­tion is reg­is­tered as “female” under civ­il sta­tus law.

Now the man wants to use his law firm to force us to stop refer­ring to him as a man because it would “unjus­ti­fi­ably” inter­fere with his “gen­er­al per­son­al rights”. If we do not stop doing this, we are to promise to pay a “con­trac­tu­al penal­ty to be deter­mined at our rea­son­able dis­cre­tion” “for each case of infringe­ment”.

Our responses to the allegations

Our lawyer Jonas Jacob has clar­i­fied that our des­ig­na­tion is fac­tu­al and cov­ered by free­dom of expres­sion.

  1. Call­ing me a man: Our term is fac­tu­al and not defam­a­to­ry, but cov­ered by free­dom of expres­sion.
  2. Jus­ti­fied crit­i­cism of gen­der iden­ti­ty ide­ol­o­gy: Our arti­cles and des­ig­na­tions are based on biol­o­gy and the preser­va­tion of women’s rights.
  3. Not aimed at indi­vid­ual per­sons: Our reports are not aimed at the indi­vid­ual per­son, but at the entire process.
  4. Accu­sa­tion of untrue state­ments of fact: Our state­ments relate to the entire process, not just the con­tact.


What does the process mean for the #Selbstbestimmungsgesetz?

We would like to have the high­ly con­tro­ver­sial “Self-Deter­mi­na­tion Act” (SBGG ), which is harm­ful to young peo­ple and women, repealed. This is only pos­si­ble with the help of court pro­ceed­ings in which it is estab­lished that we are allowed to state obvi­ous facts oth­er than those pre­scribed by the SBGG. For exam­ple, that a man remains a man and can be per­ceived as such despite a change in civ­il sta­tus through an act of speech. A man does not belong in women’s shel­ters. We will go through all instances up to the Fed­er­al Con­sti­tu­tion­al Court. This is a prece­dent. In order to get through this process, we need broad finan­cial, polit­i­cal and social sup­port.

The Fed­er­al Con­sti­tu­tion­al Court must decide whether the SBGG is com­pat­i­ble with free­dom of opin­ion and free­dom of the press. The fine pro­vi­sion of the SBGG, the “pro­hi­bi­tion of dis­clo­sure”, which penal­izes the nam­ing of obvi­ous facts with up to 10,000 euros, unrea­son­ably restricts free­dom of expres­sion. Free­dom of opin­ion, free­dom of the press and free­dom of speech are fun­da­men­tal pre­req­ui­sites for the func­tion­ing of democ­ra­cy and the rule of law. We want to defend that.
